About these Terms

This website and store are operated by Cagil Enterprises Pty Ltd trading as Who Wants 2 Party (ABN 70 155 463 817). These Terms and Conditions apply to all purchases made from www.whowants2party.com.au and to your use of this website. By placing an order you agree to be bound by these Terms and Conditions.

These Terms form part of the agreement between you and us and operate in addition to any non-excludable rights under the Australian Consumer Law.

Definitions

In these Terms, we, us and our mean Cagil Enterprises Pty Ltd trading as Who Wants 2 Party. You and your mean the purchaser and user of the website. Products means goods offered for sale on the website.

Territory

We ship within Australia and to New Zealand only.

Website use

You agree to provide accurate details when creating an order or account. All content on the website is provided in good faith. Sizes and measurements are approximate and colour appearance may vary by screen and lighting.

Pricing and GST

Prices are shown in Australian dollars and include GST unless stated otherwise. We may update prices at any time. If a pricing error is identified for a Product you have ordered, we will contact you to confirm the correct price or cancel the order and refund any amounts paid.

Payment

Payment is taken at the time you place your order. Accepted payment methods may include Visa, Mastercard, American Express, PayPal and Afterpay. Your order will not be dispatched until payment has been received in full.

Orders and acceptance

After you submit an order you will receive an order acknowledgement email. This is not our acceptance of your order. Acceptance occurs when we dispatch the Products. We may refuse or cancel any order at our discretion, including where Products are unavailable or an error is found. If we cannot supply an item we will notify you as soon as possible and provide a full refund for the unavailable item if payment has been received.

Availability and substitutions

All Products are offered subject to availability. We do not offer substitutions without your consent.

Delivery areas, details and charges

Delivery charges and options are shown at checkout. You must provide full and accurate delivery details including business names, unit or level numbers and correct postcodes. We are not responsible for delays or non-delivery caused by incomplete or incorrect addresses or by factors outside our reasonable control.

Dispatch times and delays

We aim to dispatch orders promptly and many orders placed before our cut-off are dispatched from Sydney. Delivery timeframes are estimates only and are not guaranteed. We are not liable for delay or failure to deliver due to events outside our reasonable control.

Authority to leave and first attempted delivery

If you request authority to leave, or leave instructions such as leave at front door or leave with neighbour, risk passes when the parcel is delivered as instructed. Risk also passes on the first attempted delivery where a carrier records an attempted delivery and the parcel is subsequently held for collection or redelivery.

Risk and title

Risk in the Products passes to you on delivery to the address you provide or on first attempted delivery. Title to the Products passes when we receive full payment for those Products.

Click and Collect

Where offered, Click and Collect orders may require photo identification or order confirmation at pickup. We may cancel a Click and Collect order if items are not collected within a reasonable period, in which case we will refund you less any reasonable costs incurred.

Product use and safety

You are responsible for safe and proper use of all Products. Balloons and inflation equipment require care and adult supervision. Over inflation may cause balloons to burst. Helium should never be inhaled. We accept no liability for damage, injury or loss arising from incorrect or irresponsible use of Products. Always follow the instructions and warnings provided with the Products.

Missing or damaged items on arrival

Please check your order promptly on delivery. Missing items or transit damage must be reported to us within 24 hours of receipt so we can assist with investigation and replacement where appropriate.

Change of mind returns

If you change your mind you may request a return within 30 days of receipt. Returned items must be unused, in original condition and packaging, and accompanied by a valid RMA number. You can obtain an RMA by visiting our Returns Policy page and following the instructions.

Change of mind returns are not accepted for special orders or for items discounted specifically for you. For hygiene and safety reasons certain items may be excluded from change of mind returns where permitted by law.

You are responsible for return postage and for the goods until they are received back at our address. We recommend tracked postage and adequate packing.

Refunds

After approved returns are received and inspected we will process refunds within 30 days to the original payment method where possible. Delivery charges for the original shipment and your return postage are not refundable unless required by law.

Faulty goods and your rights

Your rights under the Australian Consumer Law apply in addition to any policy described here. If a Product fails to meet a consumer guarantee you are entitled to a remedy. Please contact us with your order number and a description of the issue so we can assist.

Cancellations and order changes

Orders are processed quickly. If you need to cancel or modify an order contact us immediately. We will assist where possible, however changes may not be possible once picking has commenced. If a cancellation is approved after payment has been captured, a reasonable administration fee may apply to cover processing costs.

Promotions and coupon codes

Promotion terms will be stated with the offer. Unless noted otherwise, coupon codes are single use, cannot be combined with other offers and exclude shipping fees. Free shipping promotions apply to standard services unless specified. Promotions do not apply to previous orders. Stock is subject to availability.

Accuracy of information

We try to ensure information, images and specifications are correct. Minor variations in colours, finishes and measurements may occur. If a material error is identified for a Product you have ordered we will contact you to discuss options or cancel and refund the affected item.

Events outside our control

We are not liable for delay or failure to perform caused by events outside our reasonable control including carrier delays, severe weather, strikes, government action, pandemics or supply interruptions.

Limitation of liability

To the extent permitted by law, our liability is limited at our option to replacing the Products, supplying equivalent Products, repairing the Products, or refunding the amount paid. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Privacy

Our handling of personal information is described in our Privacy Policy available on the website.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on the website. It is your responsibility to review the Terms whenever you use the website or place an order.

By completing and submitting an order you confirm that you have read and agree to these Terms and Conditions.
